Mandatory Jail Sentences
New Jersey law imposes mandatory minimum jail sentences for DUI offenders, depending on the level of intoxication, the number of prior offenses, and the presence of aggravating factors. The jail sentences are as follows:
- First offense with blood alcohol concentration (BAC) of 0.08% to 0.10%: up to 30 days
- First offense with BAC of 0.10% or higher: up to 90 days
- Second offense within 10 years: 2 to 90 days
- Third or subsequent offense within 10 years: 180 days
- Any offense with BAC of 0.15% or higher: mandatory ignition interlock device installation for 6 months to 1 year after license restoration
- Any offense with a minor passenger in the vehicle: additional 5 days of jail time
- Any offense in a school zone or within 1,000 feet of a school: additional jail time and fines
Community Service Requirements
In addition to jail time, New Jersey law also requires DUI offenders to perform community service, which can range from 12 to 90 hours, depending on the number of prior offenses and the discretion of the court. Community service can include any type of unpaid work that benefits the public, such as cleaning parks, roads, or schools, volunteering at a hospital, nursing home, or animal shelter, or participating in an alcohol or drug education program.
